It pointed out that the dual definition “can act as a disincentive to new investment and modernization by discouraging modifications to existing facilities” and “can actually retard progress in air pollution control by discouraging replacement of older, dirtier processes or pieces of equipment with new, cleaner ones.” Ibid. Moreover, the new definition “would simplify EPA’s rules by using the same definition of ‘source’ for PSD, nonattainment new source review and the construction moratorium.
